Madrid City Council published its 2025 enforcement results in May 2026. Among the headline figures was a substantial increase in inspections of homes used for tourist accommodation and in enforcement actions.
What figures did Madrid publish?
According to the City, inspections of homes used by tourists in 2025 almost tripled compared with 2024, while the number of fines increased by 27%.
In addition, 323 unlicensed tourist homes were returned to residential use in 2025, 33% more than in 2023.
What does this trend show?
Administrative enforcement of tourist accommodation is becoming increasingly important in major cities. Being listed on a commercial platform does not replace the planning or tourism authorisations required by law.
A property can generate income for months and still face proceedings if its planning or tourism authorisation is not valid.
What should an owner check?
- That tourist use is compatible with planning rules.
- That any declaration, licence or authorisation is valid.
- That the property meets sector-specific requirements.
- That the condominium has not adopted a valid prohibition or restriction.
Prevention matters
Madrid's figures show that the risk is not limited to large fines. Administrative proceedings can also create costs, loss of income and an obligation to restore residential use.
